These terms and conditions outline the rules and regulations for the use of ChrysArte's Website, located at https://chrysarte.com, services, programmes and other interactions with ChrysArte.

These Terms & Conditions govern your use of the ChrysArte website

In these Terms, “ChrysArte,” “we,” “us,” or “our” refers to ChrysArte - Art Platform, operating under the name ChrysArte. “You,” “your,” or “user” refers to any person accessing the website, submitting information, applying to a programme, purchasing or enquiring about an artwork, requesting a service, or otherwise engaging with ChrysArte.

By accessing this website, or engaging with ChrysArte, you acknowledge that you have read and understood these Terms and agree to be bound by them. If you do not agree, please do not use the website or submit information through it.

1. About ChrysArte

ChrysArte is an independent contemporary art platform working with artists through exhibitions, residencies, collaborations, projects, art advisory and related services.

Our activities may include, but are not limited to:

  • presenting and promoting artists and their work;

  • organising exhibitions and art projects;

  • developing and facilitating residency programmes;

  • providing opportunities for artists;

  • facilitating artwork enquiries, acquisitions and commissions;

  • providing art advisory and consultancy services;

  • developing partnerships and collaborations;

  • publishing editorial, educational and promotional content;

  • operating newsletters, communities and digital communications; and

  • connecting artists, collectors, institutions, organisations and other members of the art community.


Individual programmes and services may have additional terms. Where additional terms are provided, those terms will apply to the relevant programme, transaction or engagement.

2. Use of the Website

You may use the website for lawful purposes and in accordance with these Terms.

You must not:

  • use the website for fraudulent, unlawful or misleading purposes;

  • attempt to gain unauthorised access to the website or its systems;

  • interfere with the operation or security of the website;

  • introduce malicious code, viruses or other harmful material;

  • copy, reproduce or commercially exploit website content without permission;

  • impersonate another person or organisation;

  • submit information that is knowingly false, misleading or unlawful;

  • infringe another person's intellectual-property or privacy rights; or

  • use information obtained from the website to harass, target or exploit another person.

We may restrict or suspend access where we reasonably believe that the website or our services are being misused.

Website content is provided for general information unless expressly stated otherwise.

Images of artworks may vary slightly from the original work due to photography, scanning, lighting, screen settings and digital display.

Dimensions, materials, dates, prices and other artwork information should be confirmed with ChrysArte before any acquisition or contractual commitment.

5. Artwork Enquiries & Acquisitions

Artwork displayed on the website may be available for inquiry, acquisition, exhibition or other purposes. Inclusion on the website does not necessarily mean that an artwork remains available for purchase.

Availability must be confirmed by ChrysArte.

An inquiry does not constitute a sale or reservation.

A sale becomes binding only when the relevant terms, price, payment arrangements and other applicable conditions have been confirmed by ChrysArte and, where applicable, payment has been received.

Prices may be displayed in Pakistani Rupees, United States Dollars or another currency. Unless expressly stated otherwise, quoted prices may not include shipping, insurance, customs duties, taxes, framing, installation or other destination-specific costs.

International buyers are responsible for any import duties, customs charges, taxes, permits or other charges imposed by the destination country unless expressly agreed otherwise.

Where ChrysArte facilitates the sale of an artwork on behalf of an artist or other owner, the terms of the relevant transaction will determine the parties to the sale and the applicable obligations.

6. Artwork Information & Authenticity

ChrysArte takes reasonable care in presenting artwork information supplied by artists, owners, galleries, estates or other relevant parties.

Where applicable, certificates of authenticity, provenance information, condition reports and other documentation will be provided or made available in accordance with the specific artwork and transaction.

Unless expressly stated in writing, ChrysArte does not warrant that every artwork is accompanied by a particular form of documentation.

Any known condition issues or material limitations relevant to a transaction will be disclosed where reasonably available.

7. Payments, Shipping & Delivery

Payment terms, accepted payment methods and delivery arrangements will be communicated for the relevant transaction.

Where shipping is arranged through ChrysArte or a third-party provider, delivery times are estimates and may be affected by circumstances outside our control.

Responsibility for an artwork during transit will depend on the agreed shipping and insurance arrangements.

Buyers are responsible for providing accurate delivery information and for complying with applicable import and customs requirements.

No artwork should be considered dispatched until the applicable payment and delivery requirements have been satisfied.

8. Refunds, Returns & Cancellations

Refunds, returns, exchanges and cancellations are subject to the nature of the transaction, the terms communicated at the time of purchase or booking, and any applicable law.

Artwork Purchases

Because artworks are individual and often unique works, artwork sales are generally final once a purchase has been confirmed and payment has been received. Returns or refunds are not ordinarily available simply because a purchaser changes their mind.

If an artwork arrives damaged, materially differs from the description provided, or there is another significant issue with the order, please contact ChrysArte as soon as possible after delivery with details and, where applicable, photographs or other supporting information. We will review the matter and determine the appropriate resolution, which may include repair, replacement where reasonably possible, return or refund.

Where an artwork is being sold on behalf of an artist or third party, any applicable return or refund arrangements may also be subject to the terms agreed with that artist or seller.

Commissions

Commission payments, deposits and other amounts paid towards commissioned artworks are non-refundable once work has commenced, unless otherwise agreed in writing.

If a commission is cancelled before work begins, any refund will depend on the terms agreed for that particular commission, including any non-refundable administrative, consultation, material or other costs.

Residency Fees

Residency fees, deposits and other payments relating to a residency are subject to the cancellation and refund terms communicated for the relevant residency or programme.

Where a residency is cancelled by ChrysArte or the residency cannot proceed for reasons attributable to ChrysArte, the applicable refund or alternative arrangement will be communicated to the participant in accordance with the circumstances.

Where a participant cancels or withdraws, any refund will depend on the cancellation terms applicable to that particular residency. Visa fees, travel costs, insurance, materials, personal expenses and other third-party costs may be non-refundable and are generally the responsibility of the participant unless expressly stated otherwise.

Appointments

Appointments are generally free of charge. If a paid service or consultation is introduced, its cancellation and refund terms will be communicated before payment is requested.

Refund Processing

Where ChrysArte approves a refund, the refund will generally be made using the original payment method where reasonably possible. Processing times may vary depending on the payment provider, bank or other financial institution.

Nothing in this section limits any mandatory rights or remedies that may apply under applicable law.

9. Commissions

ChrysArte may facilitate commissioned artworks between artists and clients.

A commission may involve discussion of:

  • the artist;

  • concept or artistic direction;

  • dimensions and materials;

  • location and intended use;

  • timeline;

  • fees and payment schedule;

  • revisions or approvals;

  • installation or delivery; and

  • intellectual-property and reproduction rights.

Commission arrangements may require a separate written agreement.

Unless expressly agreed otherwise, the artist retains ownership of copyright in the resulting artwork. Purchase of a physical artwork does not automatically transfer copyright, reproduction rights or other intellectual-property rights.

10. Exhibitions

Exhibition dates, participating artists, venues, artworks and related programming may change where circumstances require.

Participation in an exhibition does not guarantee sales, publicity, awards, future representation or further opportunities.

Where an artist participates in an exhibition, the artist may be required to comply with separate exhibition terms relating to artwork delivery, condition, installation, insurance, sales, commissions, promotion, reproduction and collection.

Any exhibition-specific agreement will take precedence over these general Terms where the two documents conflict.

11. Artist Submissions

Artists may submit portfolios, artwork images, CVs, statements, proposals and other materials through the website or other ChrysArte channels.

A submission does not guarantee:

  • representation;

  • exhibition;

  • sale;

  • residency placement;

  • commission;

  • publication;

  • partnership; or

  • any other opportunity.


ChrysArte may review submissions according to the requirements, artistic direction and availability of the relevant programme.

We are not required to provide individual feedback on every submission.

Artists should submit only material they have the right to share.

By submitting material, you confirm that:

  • the information supplied is accurate to the best of your knowledge;

  • you have the necessary rights or permissions to submit the material;

  • the submission does not knowingly infringe another person's rights; and

  • you have authority to grant the permissions described below.


You retain ownership of your submitted work.

By submitting material, you grant ChrysArte a non-exclusive, worldwide, royalty-free permission to review, store and use the material for the purposes of evaluating the submission and, where relevant, considering or promoting the artist, programme or related ChrysArte activity.

We will not acquire ownership of an artwork merely because it has been submitted to us.

Where ChrysArte wishes to use submitted material publicly for promotional, editorial, exhibition or other purposes beyond the submission process, we may seek the appropriate permission or rely on a separate agreement where applicable.

12. Residencies

ChrysArte may operate residency programmes in Pakistan and internationally, either independently or in collaboration with partner organisations, artists, curators, institutions or other parties.

Each residency may have its own eligibility requirements, application process, fees, funding arrangements, inclusions, dates, location, accommodation, travel arrangements, visa requirements and participation conditions.

Information published on the website is subject to the specific terms of the relevant residency call or programme agreement.

Submitting an application does not guarantee selection.

Selection decisions are made according to the criteria and curatorial requirements of the relevant programme.

Where a residency includes accommodation, travel, meals, visas, tickets, studio facilities, mentoring, cultural activities or other provisions, the exact inclusions will be stated in the relevant programme information or agreement.

Participants remain responsible for complying with immigration, visa, health, travel, insurance and other legal requirements applicable to their circumstances.

ChrysArte may modify dates, locations, schedules, accommodation or programme activities where reasonably necessary due to operational, safety, governmental, travel or other circumstances.

Additional residency-specific terms may apply.

13. Partnerships & Collaborations

ChrysArte may enter into partnerships and collaborations with artists, galleries, residency platforms, institutions, brands, cultural organisations, educational organisations, collectors and other entities.

Information about partners and collaborative projects is provided for informational purposes and does not necessarily constitute an endorsement of every service, product, statement or activity of a partner.

Where a collaboration involves a separate organisation, that organisation's own terms and policies may apply to its services.

Unless expressly agreed otherwise in writing, ChrysArte is not responsible for the acts, omissions, products, services or policies of independent third parties.

14. Art Advisory & Consultancy

Where ChrysArte provides art advisory, consultancy, acquisition assistance or related services, the scope of the service will depend on the specific engagement.

General information or recommendations provided through the website, email, WhatsApp or other communication channels do not constitute financial, investment, legal, tax, insurance or other regulated professional advice.

Art values, market conditions and future resale prices are inherently uncertain. ChrysArte does not guarantee appreciation, resale value or investment performance of any artwork.

15. Appointments

Appointments may be requested for artwork viewing, acquisition enquiries, artist information, portfolio presentations, commissions, consultations, exhibitions, collaborations or other art-related matters.

Appointments are subject to availability and are not confirmed until ChrysArte provides confirmation.

Appointments are complimentary unless expressly stated otherwise.

Cancellation and rescheduling requests should be communicated as early as reasonably possible. Repeated no-shows may affect the ability to secure future appointments.

16. Newsletter & Communications

Where you subscribe to the ChrysArte newsletter or other marketing communications, you consent to receiving information such as:

  • exhibitions;

  • artist presentations;

  • residency opportunities;

  • open calls;

  • events;

  • partnerships;

  • artworks and acquisitions;

  • projects; and

  • other ChrysArte updates.

You may unsubscribe from marketing communications at any time using the unsubscribe mechanism provided or by contacting us.

Transactional or service-related communications may still be sent where necessary to respond to an enquiry, application, booking, purchase or other interaction.

17. Intellectual Property &License

Unless otherwise stated, ChrysArte and/or its licensors own or hold the relevant rights to the intellectual property contained in this website, including its original text, branding, logos, graphics, design, layouts and other website materials. All rights not expressly granted are reserved.

You may access and use the website for your own personal, non-commercial purposes, subject to these Terms.

You must not, without prior written permission:

  • copy or republish material from the website;

  • reproduce, duplicate or substantially reproduce website content;

  • sell, rent or sublicense website material;

  • redistribute website content;

  • commercially exploit website content; or

  • remove or alter copyright, trademark or other proprietary notices.


Artwork images, artist statements, biographies, photographs and other materials relating to artists remain the property of their respective artists, owners or rights holders unless otherwise stated.

Displaying an artwork or artist's work on the website does not transfer copyright, ownership or reproduction rights to you.

You may not reproduce, distribute, commercially use or otherwise exploit an artist's work or other protected material displayed on the website without obtaining permission from the relevant rights holder.

18. Linking to ChrysArte

You may link to the ChrysArte website where the link is lawful, accurate, non-deceptive and does not falsely suggest sponsorship, endorsement, partnership or approval by ChrysArte.

You must not frame or reproduce the ChrysArte website within another website without our permission.

You may not use the ChrysArte name, logo, artwork or other brand assets in a way that suggests an unauthorised affiliation or endorsement.

We reserve the right to request removal of any link to ChrysArte that we reasonably consider inappropriate, misleading, unlawful or inconsistent with these Terms.

If you wish to use ChrysArte branding or establish an official promotional or partnership link, please contact us for permission.

19. User-Submitted Content

If you submit text, images, photographs, portfolios, proposals, comments or other content to ChrysArte, you remain responsible for that material.

You must not submit content that is unlawful, defamatory, fraudulent, threatening, discriminatory, infringing, malicious or otherwise inappropriate.

You grant ChrysArte the permissions reasonably necessary to receive, review, store and process your submission for the purpose for which it was provided.

We may remove or decline to publish submitted content at our discretion.

20. Third-Party Websites & Services

The website may contain links to third-party websites, social-media platforms, payment providers, shipping providers, application systems or other external services.

These services operate independently from ChrysArte and may have their own terms and privacy policies.

We are not responsible for the content, security, availability, policies or practices of third-party services.

To the maximum extent permitted by applicable law, ChrysArte will not be liable for indirect, incidental, consequential or unforeseeable loss or damage arising from or connected with your use of the website or participation in a programme or service.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

Where a third party independently provides a service, ChrysArte is not responsible for losses arising from that third party's acts or omissions, except to the extent otherwise required by applicable law.

Nothing in these Terms limits any statutory rights or protections that cannot lawfully be excluded.

24. Force Majeure

ChrysArte will not be responsible for delay, cancellation or failure to perform an obligation where this results from circumstances beyond our reasonable control.

These may include natural disasters, severe weather, public-health emergencies, war, civil unrest, government restrictions, visa restrictions, transport disruption, strikes, technical failures, security incidents or other circumstances that could not reasonably have been prevented.

Where possible, we will communicate material changes and seek a reasonable alternative.

25. Minors

Some ChrysArte programmes or opportunities may involve participants under the age of 18.

Where a participant is a minor, the relevant parent, guardian, school or authorised adult may be required to provide consent and accept additional programme-specific terms.

The collection and use of information relating to minors will be handled in accordance with applicable requirements and the relevant programme arrangements.

Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.

By using the website or submitting information, you acknowledge that your information may be collected and processed as described in the Privacy Policy.

These Terms, together with any programme-specific terms, written agreements, purchase terms or other documents expressly incorporated into an engagement, constitute the applicable agreement between you and ChrysArte regarding the relevant service or interaction.

Additional Agreements

Certain services, programmes, exhibitions, artwork transactions, commissions and collaborations may be subject to additional terms or separate agreements. Where applicable, those terms will be provided to the relevant participant, artist, client, collector or partner and will govern the specific engagement. In the event of a conflict between these Terms & Conditions and a specific written agreement, the specific agreement will apply to the extent of that conflict.
